What we collect, and what we do with it.

Overnight Filing handles some of the most sensitive information a person has. This page explains, in plain English, what we collect through this website and how we treat it.

Who we are

What this policy covers

This policy covers information collected through this website. Information you give us as a client — your tax documents, identification numbers and anything else needed to prepare a return — is additionally governed by federal law on tax return preparers, including the confidentiality rules in Internal Revenue Code section 7216, and by our engagement letter with you.

What we collect through this site

Please do not send sensitive data through this website. The contact form is for scheduling only. Never send us a Social Security number, an ITIN, a photo of your ID or a tax document by web form or by ordinary email. Bring them in, or ask us for a secure method.

Why we use it

We use what you send through the form to answer your enquiry, confirm an appointment, tell you what to bring, and quote a fee. If you become a client, we use the information you provide to prepare and file your returns and to contact you about them. We do not use it to build a marketing profile.

Who we share it with

We do not sell your information, and we do not share it with advertisers. Limited sharing happens only where it is necessary to run the office or required by law:

  • Our website host and, once configured, the form handler that delivers the contact form to us
  • The IRS and the California Franchise Tax Board, when we transmit a return you have signed and authorised
  • Professional software providers used to prepare and e‑file returns, under their own confidentiality obligations
  • Where a subpoena, court order or law requires it

Beyond that, a tax return preparer may not disclose or use your tax return information without your written consent. We take that seriously and we will ask you in writing if a situation ever calls for it.

How long we keep it

Enquiries that do not become appointments are kept only as long as they are useful, and then deleted. Client records are retained for the period required for tax return preparers and by our own professional obligations — [RETENTION PERIOD — to be confirmed] — after which they are securely destroyed.

How we protect it

Paper files are held in the office and are not left where visitors can read them. Electronic records are kept on password-protected systems with access limited to the people who need it. No method of transmission over the internet is perfectly secure, which is exactly why the form on this site is limited to scheduling details.

Your choices

You can ask us what we hold about you, ask for a correction, or ask us to delete an enquiry, by calling or emailing the office. California residents have additional rights under state privacy law over personal information held about them; contact us and we will explain how those apply and respond within the time the law allows. We will never treat you differently for exercising them.

Children

This site is not directed at children and we do not knowingly collect information from them through it. Information about dependants supplied by a parent or guardian for a tax return is handled as part of that return.

Links to other sites

Where we link to the IRS, the Franchise Tax Board or another organisation, their privacy practices are their own and this policy does not cover them.

Changes to this policy

If we change how we handle information we will update this page and the date at the top. Material changes will be flagged clearly rather than slipped in.
